摘要
"一带一路"倡议是中国政府在基础设施建设和投资方面采取的一项全球发展倡议,覆盖了位于亚洲、欧洲、非洲、中东和美洲的152个国家和国际组织。"一带"即"丝绸之路经济带",指陆路和铁路运输路线;"一路"即"21世纪海上丝绸之路",属于海上路线。此外,中国还重点建设国际陆海贸易新通道。该通道贯穿全球71个国家和地区的155个港口,将丝绸之路经济带更好地连接起来。国际陆海贸易新通道是中国西部省份与东盟国家在中新(重庆)战略性互联互通示范项目倡议框架下共同建设的贸易物流通道。因此,国际陆海贸易新通道将利用包括铁路、公路、水路和航空路线在内的各种运输方式,到达世界上更多的地区。本文论述了中国与国际陆海贸易新通道沿线国家之间存在的法律问题,并就解决中国与国际陆海贸易新通道成员国之间的问题提出建议。
"The Belt and Road"Initiative(BRI)is a global development initiative adopted by the Chinese government involving infrastructure development and investments.It covers 152 countries and international organizations in Asia,Europe,Africa,the Middle East,and the Americas."Belt"refers to the overland routes for road and rail transportation,called"the Silk Road Economic Belt";whereas"road"refers to the sea routes,or"the 21st Century Maritime Silk Road".Moreover,it has linked 155 ports in 71 countries and regions worldwide,better connecting the Silk Road Economic Belt.The New International Land-Sea Trade Corridor is a trade and logistics passage jointly built by western Chinese provinces and ASEAN countries under the framework of the China-Singapore(Chongqing)Demonstration Initiative on Strategic Connectivity.Therefore,it will take advantages of various transport options including railways,highways,water and air routes.This land-sea corridor enables access to more regions across the world.This paper addresses that what the legal problems of between China and states involving in the construction of the New International Land-Sea Trade Corridor are and how to solve the problems among them.
