Research on Rule of Law Protection and Legal Services for"One Belt,One Road"Construction——From an Arbitration Perspective

随着我国“一带一路”倡议的提出和发展,跨境争议纠纷对国际商事争端解决机制提出了更高的期待。仲裁具备高效性、灵活性、保密性、契约性等优势,考虑到绝大多数“一带一路”沿线国家都加入了《承诺及执行外国仲裁裁决公约》(以下简称《纽约公约》),且我国在调解和远程庭审方面具有领先优势,仲裁有望逐渐成为最理想的国际商事争议解决方式。但我国仲裁市场尚处于发展不平衡、单打独斗的劣势地位,为保障“一带一路”的顺利实施,需要结合“一带一路”的特点和广州市的情况,努力加强粤港澳大湾区仲裁联盟建设,创新业务模式,提升专业水平,吸纳法律人才,才能在国际纠纷解决这一重要领域发出中国声音。

With the introduction and development of China’s"One Belt,One Road"initiative,cross-borde disputes have raised higher expetations for inernational commercial dispute resolution mechanisms.Considering that most of the countries along the“One Belt,One Road”have acceded to the New York Convention,and that China has the leading edge in mediation and remote hearings,arbitration is expected to gradually become the most desirable mode of international commercial dispute resolution.However,China’s arbitration market is still at a disadvantage of unbalanced development and solo efforts.To ensure the smooth implementation of"One Belt,One Road",we need to take into account the characteristics of"One Belt,One Road"and the situation of Guangzhou City,and strive to strengthen the construction of the Guangdong-Hong Kong-Macao Greater Bay Area Arbitration Union,innovate in order to ensure the smooth implementation of"One Belt,One Road",we need to strengthen the construction of the Guangdong-Hong Kong-Macao-Greater Bay Area Arbitration Union,innovate the business model,improve the professional level and absorb legal talents,so as to make China’s voice heard in this important area of international dispute resolution.
