改革尚未成功:我国仲裁机构地域性困局论纲

Mission Uncompleted:The Territorial Dilemma of China’s Arbitration Institutions

在仲裁机构民间化改革大方向已非常清晰的情况下,地域性困局制约着我国仲裁业的良性发展,但却基本未进入仲裁体制改革讨论的场域。仲裁体制改革的多重目标设定使地域性问题为去行政化所裹挟,而自上而下的行政驱动模式也内化了原先的地域性格局。地域性与行政化之间事实上存在内在的勾连共生关系,仲裁体制进一步改革中的诸多其他命题也因此无法从这里绕行。走出地域性困局的钥匙还得在去行政化的进一步改革过程中寻找。

With decentralization being a self-evident aim of China’s arbitration reform,the territorial dilemma,which has been little discussed,remains a formidable gap to be bridged.While it was integrated with centralization,the ways out are also to be sought in the process of further decentralization.
