新业态从业人员职业伤害保障路径研究

摘要 数字时代衍生出有别于传统用工模式的新就业形态,逐步成为促进就业的增长极。与此同时,新业态从业人员职业伤害难以得到有效救济,业已成为数字时代的一大痛点。新业态从业人员职业伤害保障困境在于从业者数量众多且职业伤害风险较大,灵活就业人员保障缺位且难以纳入工伤保险框架,商业保险部分失灵且公平性不足。为此,应增强新业态从业人员职业风险防范意识与能力;围绕参保、缴费、认定、支付核心环节设计专门的新业态从业人员职业伤害保障制度;推动职业伤害保障与商业保险融合发展,以期实现全覆盖、多层次、高水平的职业伤害保障体系。 The digital era has derived a new employment form that is different from the traditional employment mode,and has gradually become the growth pole to promote employment.At the same time,it is difficult for new business employees to get effective relief,which has evolved into a major social pain point in the digital age.The dilemma of new business forms is the large number of practitioners and the high risk of occupational injury,the protection of flexible employment personnel is absent and it is difficult to be included in the framework of industrial injury insurance,and the commercial insurance part fails and the fairness is insufficient.For this end,the occupational risk prevention awareness and ability should be enhanced;design special occupational injury protection system for new business practitioners around the core links of insurance,payment,identification and payment;promote the integrated development of occupational injury protection and commercial insurance in order to realize full coverage,multi-level and high-level occupational injury protection system.
