法治化语境下“校闹”内涵、成因与治理体系

摘要 “校闹”本质上是严重扰乱正常教育教学秩序、侵犯学校及师生合法权益的违法行为,将“校闹”治理纳入法治化轨道势在必行。从法理视角看,法律意识淡薄、学校安全法制保障不足、执法司法不严是“校闹”形成的主要原因。为此,在构建“校闹”治理法治化体系过程中,亟需重视法治宣教以提高法律意识;加快校园安全立法以完善法律保障体系;成立家校纠纷调解委员会以丰富治理手段;严格执法、公正司法以筑牢法治防线。 “School disturbances”are essentially illegal acts that seriously infringe on the legitimate rights and interests of schools,teachers and students,and disrupt the normal education and teaching order,and it is imperative to bring the governance of“school disturbances”into the track of the rule of law.From a legal point of view,the main reasons for the formation of“school disturbances”are weak legal awareness,insufficient legal guarantees for school safety,and lax law enforcement and justice.To this end,in the process of building a legal system for“school noise”governance,it is urgent to attach importance to rule of law education to improve legal awareness;accelerate campus safety legislation to improve the legal protection system;establish a home-school dispute mediation committee to resolve disputes in a timely manner;strictly enforce the law and administer justice to build a solid defense line for the rule of law.
