论个人信息的法律保护——基于我国公共卫生事件的思考

On the Legal Protection of Personal Information Viewed from Public Health Incidents in China

由于我国个人信息保护相关法律规制不健全,以及行业自律性较低,在公共卫生事件中个人信息泄露事件时有发生。文章在对个人信息保护做出法理阐释的基础上,研究我国信息保护法治工作的现状,提出出台专门《个人信息保护法》,明确个人信息采集条件,规制个人信息的处理,重视个人信息的后续保护等完善我国个人信息保护法治建构的相关建议,以期在互联网大数据技术高速发展的今天,有效保护公民的信息安全。

Due to the imperfect laws and regulations related to the protection of personal information in China and the low self-discipline of the industry,information leakage incidents occur from time to time in public health incidents.Based on the legal interpretation of personal information protection,this paper studies the current situation of the legal work of information protection in China.Meanwhile,it puts forward some corresponding suggestions on improving the legal construction of personal information protection in China,such as issuing the specific Law on Personal Information Provtection,clarifying the collection conditions of person information,regulating the provcessing of personal information and stressing the follow-up provtection of personal information,hoping to effectively protect citizens’information security with the rapid development of Internet and big data technology.
