基于CiteSpace对行政应急行为的知识图谱分析

行政应急行为是应对突发事件、紧急状态下采取的一种非常态行政行为,以维护社会稳定、保护公众生命财产安全,具有现实必要性。在常态法律体系之上,建构非常态行政应急法律体系,以保障突发事件、紧急状态下各主体的合法权益。我国行政应急法律体系较为薄弱,研究热点主要聚焦行政应急行为的概念及构成要素、行政应急行为主体、行政应急行为实施程序等方面。在当前的应急法律规范体系基础上,应当明确行政应急行为中的责任主体与参与主体、职权范围,注重行政应急行为实施程序的简易化与合法性相一致,完善行政应急多元监督机制。

Acts of administrative contingency is a kind of abnormal administrative action taken in response to emergencies,in order to maintain social stability and protect the safety of public life and property.Through the construction of an abnormal administrative emergency legal system,the legitimate rights and interests of the public can be protected.The research field mainly focuses on the concept and elements of administrative emergency behavior,the main body of administrative emergency behavior,and the procedures.Future research should clarify the responsibilities of the main subject responsible for the administrative emergency action and the responsibilities of the participants,the simplification of the administrative emergency action procedure is consistent with the legitimacy,and the construction of a multiple supervision mechanism.
