基于原子图谱法的“行政问责”概念研究

Research on the Concept of “Administrative Accountability”Based on Atomic Spectrum Method

在我国,行政问责因其回应性而具有发于公共行政、兴于应急管理的特征,在不同语境下的概念不尽相同。而长期以来因概念界定方式单一,存在“行政问责”概念模糊不清,甚至将其与其他形式问责混用的情况。对此,笔者选用“原子图谱法”的数据统计指标提炼出客观聚焦心像,结合对既有概念内涵的质性分析,对“行政问责”概念实现了重新界定。通过研究,认为行政问责是具有行政授权的特定主体对行政机关及其工作人员因其故意或过失而产生与其职权、职责不符的行为进行事后监督,包括以质询、质疑来究其原因以及通过强制手段令其承担否定性后果的方式追究其责任的行政行为与活动。

Administrative accountability is characterized by its responsiveness,which originates from public administration and thrives on emergency management in China.Its concepts are different in different contexts.However,for a long time,the concept of“administrative accountability”is vague and even mixed with other forms of accountability because of its single definition.In this regard,the author selected the statistical indicators of“atomic spectrum method”to extract the objective focus image,and combined with the qualitative analysis of the existing concept connotation,realized the redefinition of the concept of“administrative accountability”.It is considered that administrative accountability is an administrative act and activity in which a specific subject with administrative authorization conducts post supervision on the actions of administrative organs and their staff that are inconsistent with their powers and duties due to their intentional or negligent actions,including inquiring and questioning to find out the causes and forcing them to undertake negative consequences.
