新冠防治背景下的我国应急管理法律规范系统的构建

Construction of Legal Norm System of Emergency Management in China Under the Background of COVID-19 Prevention and Control

新冠肺炎疫情应对中暴露出来的问题为应急管理工作提出新的要求,要健全国家应急管理体系,提高处理急难险重任务的能力,保障应急管理活动所取得的成果。加强应急管理法律制定、健全应急法规体系建设及实施是贯彻落实全面依法治国战略、建设法治政府的必然要求。我国现行的法律体系难以满足应急管理实践对制度结构创新的需求。依据应急领域法学和法律规范系统理论制定应急基本法,是完善我国应急法治建设的一种选择。

To address the problems exposed in the response to COVID-19,we need to improve the national emergency management system and enhance the ability to deal with the urgent,difficult and dangerous tasks.Strengthening the rule of law in emergency management is an inevitable requirement for implementing the strategy of comprehensively governing the country by law and building a law-based government.China’s current legal system is difficult to meet the needs of emergency management practice of institutional structure innovation.According to the theory of emergency law and legal norms,the basic law of emergency is formulated to improve the rule of law of emergency in China.
