Whether a time charter period is long or short,for one trip only or a few agreed"laden legs",parties may find themselves in disputes over the time and place for redelivery from charterers to owners.Discussions may also relate to matters such as bunkers on board,the cleanliness of the cargo holds,redelivery notices and other topics central to time charter.To assist members in this,BIMCO set about drafting definitions for several of the most commonly used geographical ranges in the shipping industry.This work resulted in"Geographical Ranges",which can be found on our website.BIMCO holds the view that bunker clauses should not be used to gain unwarranted benefit,but should be kept as cost neutral as circumstances permit.It is not unusual for us to see discussions afterwards about what constitutes a dirty cargo and the best advice we can gives that,again,parties must define clearly what falls within each category.Another topic that may cause dispute is whether the time for redelivery should be according to local time or GMT.This may depend on which jurisdiction governs the content,but,in English law,the actual elapsed time-which,in practice,means conversion to GMT-will be the determining factor.
