共建共治共享社会治理格局下涉众型经济犯罪防治路径

Stakeholder Economic Crime:Ways of Prevention and Control in the Social Governance System of Co-construction,Co-governance and Sharing

涉众型经济犯罪防治与共建共治共享社会治理在理念上具有高度的契合性,但在犯罪防治方面也存在亟待解决的现实问题。涉众型经济犯罪防治需要在共建共治共享的社会治理体系指导下进行完善,通过完善社会共治法律规范、建立多元主体协同共治机制、共建涉案财物追缴退赔机制、共建联合维稳工作体系助推社会治理体系和治理能力现代化,最终实现社会治理成果全民共享。

As an important focus of realizing the modernization of social governance,the concept of stakeholder economic crime prevention and that of the social governance system of co-construction,co-governance and sharing are highly compatible.However,there are real dilemmas that need to be resolved urgently in the practice of the prevention and control of the stakeholder economic crime.In practice,the prevention and control of the stakeholder economic crime needs to be improved under the guidance of a social governance system of co-construction,co-governance and sharing,and through the improvement of social co-governance legal norms,the establishment of a multi-subject cooperative co-governance mechanism,the co-construction of a mechanism for recovering and reimbursing the property involved in the case,and the joint efforts in setting up a stability maintenance system to promote the modernization of the social governance system and governance capabilities,so as to ultimately realize the sharing of the results of social governance by all people.
