摘要
覆盖9大行业171家企业的全国性线下抽样调查显示,我国企业反贿赂合规体系已初步具备一定的组织、制度及机制基础,但整体水平仍然较低。其中,民营企业、“非优势行业”、中小型企业的合规水平大幅落后于国有企业、“优势行业”、大型企业。企业人员对贿赂(关联)行为的容忍度普遍较高,反贿赂合规的正向企业文化氛围远未达成。企业主动查处员工行贿的可能性不大,企业及相关国家机关查处贿赂行为的实际力度/影响效果较为有限。进一步改善企业营商环境,是推进我国企业反贿赂合规体系建构的关键前提,也是衡量我国反腐败斗争成效的关键指标。
A national offline sample survey covering 171 enterprises in 9 industries shows that in China,there is already a preliminary foundation for enterprises’anti-bribery compliance system in terms of organization,institution and mechanism,however,generally speaking,the foundation is still at an elementary level.Among the enterprises,the compliance of private ones,ones in’non-dominant industries’’,and small and medium-sized ones,lags significantly behind that of state-owned ones,ones in’’dominant industries’’and large ones.Tolerance of bribery(and related actions)by personnel in enterprises is generally high,and in other words,a positive corporate culture of anti-bribery compliance is far from being formed.It is unlikely for enterprises to take the initiative to investigate and punish employees for bribery.The effectiveness or impact of enterprises and related authorities to investigate bribery and impose punishment is limited.Further improvement of the business environment is a key prerequisite for advancing the construction of an anti-bribery compliance system for Chinese enterprises and also a key indicator of the effectiveness of the anti-corruption campaign in China.
