法律经验研究在中国方兴未艾,亟待发展。法律经验研究的根本特点是:运用社会科学的方法,从法律的外部来研究法律。法律经验研究是不满足于规范研究而产生的,它将研究重心从书本的法律转向实际运作的法律。同时,在以经验作为论据这方面,它与法律经济学和比较法学等相关学科有着重要的差别。法律经验研究将为中国的法治建设提供重要的知识,为法学与其它社会科学以及国际学术对话提供平台,并为形成法学研究的中国学派创造契机。

The study on legal experience in China is thriving and in urgent need of development.The basic characteristic of the study on legal experience is to study law from external aspects by using the methods of social sciences.The study on legal experience comes into being because of the dissatisfying with the normative studies,and it turns its central point from legal texts to practical operation.At the same time,with experience as grounds of argument,it is importantly different from the related subjects,such as legal economy,comparative law,and etc.The study on legal experience will provide China’s construction of government by law with important knowledge,provide legal study and other social sciences with a dialogue platform of international academy,and create moments for forming the China school in the field of legal studies.
