摘要
实践中的教育惩戒问题一直以来既是我国现行教育惩戒规范的盲点,也是当前学术界理论探讨的焦点。文本将教育惩戒权界定为学校、教师及其他教职员工等行使权利的主体在教育教学和管理中基于教育目的与职责,依法对违规违纪、言行失范的学生进行制止、管束或者以特定方式予以纠正,使学生引以为戒,认识和改正错误的职权。这有助于全面系统地构建教育惩戒规制体系,澄清其性质、内容、范围,并有效解决实践中出现的问题。
The problem of educational discipline in reality is not only the blind spot of existing regulations,but also the focus of theoretical discussion in academia.In this paper,the authors hold that"disciplinary power to educate"refers to the power of schools,teachers,non-teaching staffs and etc.,to stop,warn or correct the student,whose words or behavior violates the rules and regulations,based on the educational purposes and responsibilities authorized by the Laws and Regulations,so as to make the students learn a lesson and eventually understand and redress the misbehavior.Such definition can help construct an education discipline system,clarify its nature,content,and scope,and effectively solve the real problem.
