大数据时代建构人工智能辅助量刑系统的路径探讨

大数据深刻地改变了社会治理的运作模式和治理理念,而人工智能的快速发展与司法制度在不同层面上的耦合,对传统的法律价值观、法律理念和司法制度提出了巨大的挑战。现代司法制度必须积极响应即将到来的智慧司法实践,构建智慧法院、智慧量刑、智慧刑法运作体系。人工智能在司法实践中不应被高估,应被视为一种有效但有限的辅助手段。现阶段的人工智能辅助司法系统主要基于大数据建模,对量刑情节的提取、分析与危害危险程度的评估,以及不断地模型训练所生成。未来人工智能辅助判决系统校准程序增加情况的主要研究方向,提高数据分析能力,通过人工智能辅助系统检校司法审判程序,预防人为的疏漏,大力研发人格分析系统,谨慎规避算法黑箱问题,建立内部算法的透明化机制,树立正义的算法观等,使司法权的运作更契合法治精神。

Big data has profoundly changed the operation mode and governance concept of social governance,while the rapid development of artificial intelligence and the coupling of judicial system at different levels have posed huge challenges to traditional legal values,legal concepts and judicial system.The modern judicial system must respond positively to the coming judicial practice and construct the intelligent court,the intelligent sentencing and the intelligent criminal law operation system.Artificial intelligence should not be overestimated in judicial practice and should be regarded as an effective but limited auxiliary means.At present,the ai-assisted judicial system is mainly based on big data modeling,the extraction,analysis and assessment of the degree of harm and danger of the sentencing plot,and the generation of continuous model training.Future artificial intelligence auxiliary decision system calibration procedures increase situation of the main research direction,improve the ability of data analysis,through artificial intelligence auxiliary system calibration judicial proceedings,and to prevent human oversight,strong personality analysis system research and development,the cautious avoidance algorithm black-box problem,set up the mechanism of internal algorithm is transparent,the algorithm of justice view,etc.,make the operation of judicial power more agree with the rule of law spirit.
