必要共同诉讼人之一部提起上诉,于程序,将对整个案件产生移审效和判决确定的阻断效;同时,部分上诉效力将及于其他共同诉讼人,全体共同诉讼人得共同进入上诉审程序;于实体,二审法院的审理应当围绕上诉人的上诉请求进行,裁判主文的对象为全体共同诉讼人。实践中,应当明确部分必要共同诉讼人的上诉效力及于其他共同诉讼人;二审法院应当围绕上诉人的请求审理,判决结果对全体共同诉讼人具有约束力。为了充分保障未上诉者的程序权利,法官应当积极予以释明。若类似的必要共同诉讼人明确拒绝参加诉讼,出于尊重其处分权的考虑可以不将其纳入二审程序,但仍要受二审判决效力的约束。
