党内法规立规技术的发掘与发展——以党内法规制定条例修订切入

The Discovery and Development of the Technology of Formulating Inner-Party Regulations——Starting With the Revision of Regulations for the Formulation of Inner-Party Regulations

现有党内法规的表述还存在规范性不足、宣誓性话语较多等问题,文章通过梳理党内法规形式结构、语言表述的发展变化并结合制定条例的修订"发掘"党内法规立规技术。立规技术是对党内法规结构和内容加以形塑修饰,从而提高党内法规的科学性与规范质量,有助于党内法规制度规范化、体系化以及党内法规与国家法律相互协调衔接。党内法规体系作为中国特色社会主义法治体系的一部分,既需要科学的顶层设计,又要求条文表述严谨,用语规范。在面对相对成熟的国家法律立法技术时,它除了吸收养分、取其精华,还需要注意自身的过去与现在;区分中央与地方党内法规的立规技术,"上与下"结合协同发展;区分主干型和配套型党内法规,"内与外"互助联动发展。

There are still some problems in the expression of inner-party regulations,such as insufficient normalization and more words of vow.This paper analyzes the development of the form structure and language expression of the inner-party regulations,and combines with the revision of regulations for the formulation of Inner-party regulations to"explore"the technology of formulating inner-party regulations.The technology of formulating inner-party regulations can shape the structure and content of inner-party regulations,so as to improve the scientificity and quality of inner-party regulations,help to normalize and systematize inner-party regulations,and coordinate inner-party regulations with national laws.The inner-party regulations system,as a part of the socialist rule of law system with Chinese characteristics,not only needs scientific top-level design,but also requires rigorous expression and normative language.In the face of relatively mature legislation technology,it needs to pay attention to its past and present in addition to absorbing nutrients and essence;It needs to distinguish between the central and local inner-party regulations,so that the"upper and lower"can develop in coordination;it needs to distinguish between the main type and the supporting type of inner-party regulations,so that"internal and external"mutual aid and linkage development can be achieved.
