大数据交易中法律风险控制研究

Study on Legal Risk Control in Big Data Transactions

互联网技术的发展带动了大数据产业的兴起,但是当前我国由于立法规制的欠缺和司法审判立场的不确定性导致了大数据交易仍然缺少必要的法律保障。尽管当前对于大数据法律属性的学说主要存在三种理论,但是对大数据交易的相应保护途径并未消除其中的法律风险。目前,为满足大数据交易的法律需求时可以引用合同法的相关规定,同时外部较为宽松的法律环境也对交易起到促进作用。

The development of internet technologies has promoted the big data industry to rise. However, the deficiency of legislative regulations and the unpredictable standpoint in judicial decisions have resulted in the lack of legal protection for big data transactions in China. Currently, although there are three main theories on the nature of big data law, none of them can provide adequate protections to eliminate legal risks in big data transactions. In order to meet the demand for law in big data transactions, relevant provisions in the Contract Law can be introduced in. At the same time, tolerant legal environment can also facilitate big data transactions.
