摘要
在线教育是新时期技术与教育相结合的产物,极大地推动了我国教育信息化与教育现代化的进程。在线教育高速发展的进程中,出现了受资本裹挟而折损教育公益性、加剧教育焦虑、侵犯消费者合法权益、教育质量无法保障以及过度收集个人信息等失范行为,亟须有效监管。“双减”政策出台背景下,在线教育行业的一些乱象得到及时整治,但在线教育行业依然面临着诸多挑战和风险。未来应在考量在线教育的功能定位、在线教育新业态发展与规范之间的平衡等因素的基础上,以公益性为前提构建在线教育法律制度,通过完善在线教育立法,坚持“包容审慎”开展教育新业态的治理,构建多元治理机制来推动在线教育的风险治理。
Online education is the product of the combination of technology and education in the new era,which has greatly promoted the process of educational informatization and educational modernization in our country.In the process of the rapid development of online education,there are some anomie behaviors,such as undermining the public welfare of education,aggravating educational anxiety,infringing upon the legitimate rights and interests of consumers,the quality of education can not be guaranteed and excessive collection of personal information,which are in urgent need of effective supervision.Under the background of the“double reduction”policy,the governance of online education is faced with the risks caused by the uneven distribution of educational resources,the inability to meet the needs of family education,the difficulties in the transformation of online educational institutions and the imperfect supervision system of online education.In the future,on the basis of considering the functional orientation of online education and the balance between the development and standardization of online education new business type,we should construct the legal system of online education on the premise of public welfare,by perfecting the legislation of online education,adhere to the“inclusive and prudent”governance of education new business type,and build a pluralistic governance mechanism to promote the risk governance of online education.
