立法权的策略配置与回归——一个组织角度的探索

The Strategic Configuration and Return: Experiment from an Organizational Perspective

为了给改革开放与社会生活的秩序化提供基本的规则,全国人大及其常委会将立法权授予或委托给适宜于承担立法任务的相关机构。随着经济社会的发展,全国人大及其常委会内部组织结构不断得以健全和完善,全国人大及其常委会逐渐缩限立法授权,以期进一步提高立法质量和增强立法权的科学化。但是在实践进程中,立法组织的科层化问题仍然不同程度地存在。因此,在立法权回归的过程中应当进行新的制度化建构——以进一步完善社会主义立法民主机制来消解立法组织科层化及其负面影响。

In order to provide fundamental rules for the order of opening up and reform and social life,NPC and its Standing Committee authorize or delegate relevant agencies suitable for legislative tasks. With the development of economy and society,NPC and its Standing Committee has been continuously improving and perfecting the internal organizational structure, gradually reducing the number of law-making authorization to further improve the quality of law-making and strengthening the scientific process of lawmaking. However, the bureaucratization of law-making organization still exists in varying degrees.Therefore,in the process of law-making power returning,new system shall be also put in agenda to further improve the democratic mechanism of socialist legislation and eliminating the bureaucratization of lawmaking body and its negative impact.
