文本与数据挖掘对著作权例外体系的冲击与应对

The Impact of Text and Data Mining on Copyright Exception System and its Countermeasures

我国现有的著作权例外体系无法为文本与数据挖掘提供豁免,故挖掘行为存在侵犯著作权相关财产性权利的风险。通过对比日本、欧盟以及美国的相关司法与立法经验,认为我国文本与数据挖掘借鉴美国模式概括性适用合理使用条款是目前最具可行性的应对策略。为了使文本与数据挖掘自洽于著作权例外体系,还应采取将"四要素分析法"作为判断"三步检验法"的要件、提供合法授权的"第三方规避者"以及保持技术措施保护例外的开放性等举措。

The existing copyright exception system in China cannot provide exemption for text and data mining,so mining behavior has the risk of infringing copyright related with property rights.By comparing the relevant judicial and legislative experience of Japan,the European Union and the United States,the most feasible coping strategy for China is to learn from United States for text and data mining,and to apply fair use provisions generally.In order to make the text and data mining fit in with the copyright exception system,it is necessary to take the"four elements analysis method"as an important element to judge the"three-step test method",to provide the"third-party evader"with legal authorization,and to maintain the openness of technical measures protection exception.
