论奥林匹克标志的侵权认定——以《奥林匹克标志保护条例》为基础

On the infringement identification of Olympic Symbols——Study on the Olympic Symbols Protection Ordinance

《奥林匹克标志保护条例》的修订对我国冬奥会的顺利举办具有重要意义。采用文献资料、逻辑分析和案例分析方法分析了《条例》中关于奥林匹克标志侵权行为的认定,《条例》将以商业目的使用相同或近似的奥林匹克标志,以及利用与奥林匹克运动有关元素进行隐形营销等不正当竞争行为作为侵权的判定标准。奥林匹克标志侵权认定应以"利益平衡""合理人标准"为原则,侵权认定的限制主要包括非商业性使用、在先使用、善意使用等。为加强奥林匹克标志的保护和促进体育产业发展,建议提高奥林匹克标志保护的立法级别、明确规定奥林匹克标志权利的限制条款。

The revision of the regulation on the protection of Olympic symbols is of great significance to the smooth running of the Olympic Games.Using literature,logical analysis and case analysis,the article discusses the determination of the infringement of the Olympic symbols.The regulation use the same or similar Olympic symbols for commercial purposes and unfair competition behavior such as stealth marketing as the criteria for infringement.The identification of the Olympic symbols infringement should be based on the principle of"balance of interests"and"reasonable people",which limitations mainly include non-commercial use,prior use,and good faith use.In order to strengthen the protection of the Olympic symbols and promote the development of the sports industry,this paper suggests to raise the legislative level of the protection of the Olympic symbols and clearly stipulate the restrictive clauses of the rights of Olympic symbols.
