Analysis of the Types of Behaviors Applicable to the Safe Harbor System of the Anti Monopoly Law

党的二十大报告指出:高质量发展是全面建设社会主义现代化国家的首要任务。新修订的《中华人民共和国反垄断法》(以下简称《反垄断法》)于2022年8月1日正式实施,新法将“鼓励创新”纳入反垄断法立法目标,此举回应了我国经济高质量发展的现实需求。安全港制度的设立更是提升了执法效率,给经营者提供有效的市场预期,促进中小企业创新发展,新法明确规定安全港制度只适用于纵向垄断协议,对于横向垄断协议则是禁止适用,明晰安全港制度适用的行为类型对该制度的顺利实施具有重要意义。

The report of the 20th National Congress of the Communist Party of China pointed out that high-quality development is the primary task of comprehensively building a socialist modernized country.The newly revised Anti Monopoly Law of the People’s Republic of China(hereinafter referred to as Anti Monopoly Law)was officially implemented on August 1,2022.The new law includes“encouraging innovation”as the legislative goal of the anti monopoly law,which responds to me The practical demand for high-quality development ofthe national economy.The establishment of the safe harbor system has improved law enforcement efficiency,provided effective market expectations for operators,and promoted the innovative development of small and medium-sized enterprises.The new law clearly stipulates that the safe harbor system is only applicable to vertical monopoly agreements,and is prohibited for horizontal monopoly agreements.Clarifying the types of behaviors applicable to the safe harbor system is of great significance for the smooth implementation of the system.
