基层检察机关对财产刑执行监督方式的探析

On the Supervision Mode of Grass-roots Procuratorial Organs on the Implementation of Property Punishment

财产刑执行监督是检察机关刑事执行检察部门重要的工作项目之一,是刑事诉讼案件执行环节的重要部分,也是惩治犯罪的重点刑罚途径。而近些年来,财产刑执行一直因为执行困难、执行率低、执行监督不严等问题而被广泛关注。坚持问题导向,以实际案例为基础,对财产刑执行过程中的问题进行了初步探索,主要从财产刑执行监督的重要意义,财产刑执行监督方式存在的困境,财产刑执行监督方式的架构等三方面进行了阐述,在上述三方面中,文章主要在监督方式的架构方面,提出了个人观点,并结合司法实践要求,对监督方式的可操作性进行了详细解释。

The supervision of the execution of property punishment is one of the important work items of the criminal execution procuratorial department of the procuratorial organ.It is not only an important part of the execution of criminal cases,but also a key penalty way to punish crimes.In recent years,the implementation of property punishment has been widely concerned because of difficulties in implementation,low implementation rate,lax implementation supervision and so on.Adhering to the problem orientation and based on practical cases,the authors make a preliminary exploration on the problems in the process of property punishment execution,mainly from three aspects:the significance of property punishment execution supervision,the difficulties of property punishment execution supervision,and the structure of property punishment execution supervision.The authors mainly put forward their personal views on the structure of supervision mode,and explain in detail the operability of supervision mode in combination with the requirements of judicial practice,which has a certain significance of judicial research.
