以习近平法治思想统领检察机关的刑事审判监督工作——以刑事审判监督体系与监督能力现代化为研究视角

Leading the Procuratorial Organ’s Criminal Trial Supervision with Xi Jinping Thought on the Rule of Law——From the Perspective of Criminal Trial Supervision System and Modernization of Supervision Ability

当前检察机关面临着"两项监督;难,而刑事审判监督更难"的困境。刑事审判监督具体包括刑事审判活动监督和刑事判决裁定监督。检察机关要按照习近平总书记提出的"坚持在法治轨道上推进国家治理体系和治理能力现代化",实现审判监督工作的法治化、规范化和现代化。在实践中可借鉴"侦查监督平台"的做法,尝试开发"审判监督平台",在平台上梳理规范各个刑事审判监督事项或项目,并将平台内嵌入检察机关统一业务应用系统,实现刑事审判监督体系的现代化。同时,刑事检察官要按照习近平总书记提出的"坚持建设德才兼备的高素质法治工作队伍要求"不断提升自己,在实践中实现刑事审判监督能力的现代化转型。

At present,procuratorial organs are facing the dilemma of"two difficulties in supervision,and criminal trial supervision is more difficult".Criminal trial supervision includes criminal trial activity supervision and criminal judgment and ruling supervision.The procuratorial organs should implement the rule of law,standardization and modernization of judicial supervision in accordance with General Secretary Xi Jinping’s"insisting on promoting the modernization of national governance system and governance capacity on the track of rule of law".In practice,we can learn from the practice of"investigation supervision platform",try to develop"trial supervision platform",sort out and standardize various criminal trial supervision matters or projects on the platform,and embed the platform into the unified business application system of procuratorial organs to realize the modernization of criminal trial supervision system.At the same time,criminal prosecutors continue to improve themselves and realize the modern transformation of criminal trial supervision ability in practice in accordance with General Secretary Xi Jinping’s"insisting on building a high quality rule of law and service team with high ability and political integrity".
