The Legal Dimension of the Construction of the Special Team for the Rule of Law in Public Security

目前,法治公安建设尤其是公安法治队伍建设仍面临不小阻力,这些阻力不仅来自传统公安体制及职业习惯的惯性影响,而且有法治理念、法学教育及法治文化三个方面深层次的原因。要实现建设法治专门队伍的目标,我们必须以法治信仰为抓手,以法治理念为导向,以制度建设为保障,以公安法学理论研究为推动,立争取得公安法治队伍建设突破性的新进展。基于此,从法学理论的角度出发,对公安民警队伍的法治化路径进行阐述,以期为公安机关真正发挥法治专门队伍的重要作用提供理论支撑。

At present, the construction of public security under the rule of law, especially the construction of public security legal team, is still facing a lot of resistance. These obstacles not only come from the inertia of the traditional public security system and professional habits, but also from the three deep-seated reasons of the concept of the rule of law, legal education and legal culture. In order to achieve the goal of building a special team of rule of law, we must take the belief in the rule of law as the starting point, take the concept of rule of law as the guidance, take the system construction as the guarantee, and take the theoretical research of public security law as the impetus, so as to make a breakthrough in the construction of public security legal team.Based on this, the authors, from the perspective of legal theory, expound the path of legalization of the police force, in order to provide theoretical support for the public security organs to truly play an important role in the rule of law.
