摘要
随着“一带一路”倡议的持续推进,“绿色”理念成为国际合作的重中之重。围绕我国对外投资重点与首选地区的东盟来讲,大部分的投资项目都涉及到自然资源与能源的开发,在推进过程中对当地环境造成了一定的破坏同时也对当地居民生活产生了一定影响。要妥善解决这些问题,首先应考虑从我国国内出发,加大环境法的规制效力与环保部门的监管力度,规范“走出去”企业的投资行为;其次,应加快推进中国与东盟在投资过程中的环保合作,从双方签订的条约出发,推动中国与东盟建立区域环境组织机构,在法律监督、争端解决与合作保障等方面进行完善,共同促进中国与东盟的协同发展,助力“一带一路”的顺利实施。
Under the continuous promotion of the“one belt and one road”initiative,the concept of“green”has become the top priority of international cooperation.In terms of ASEAN,China’s foreign investment focus and preferred region,most of the investment projects are related to the development of natural resources and energy,which has caused certain damage to the local environment in the process of promotion and also has a certain impact on the lives of local residents.In order to solve these problems properly,we should first strengthen the regulatory effect of environmental law and the supervision structure,standardize the investment behavior of“going global”enterprises;Secondly,we should accelerate the environmental protection cooperation between China and ASEAN,and promote the establishment of regional environmental organizations between China and ASEAN from the treaties signed by both sides.Supervision,dispute settlement and cooperation guarantee should be improved to jointly promote the coordinated development of China and ASEAN,and help the smooth implementation of“one belt and one road”.
