Private Property Right of Personal Information Right——On Relationship Between Privacy and Personal Information Right

个人信息权的确立彰显了国家对自然人个人信息保护的重视,然而囿于原有的立法思维,新确立的个人信息权仍被定位为人格权。虽然不可否认个人信息承载着人格利益,但从隐私权与个人信息权的关系来看,其中的人格利益与隐私权客体几近一致。人格利益保护功能上的重叠,将容易造成两种权利在司法适用中的困境。与此同时,在个人信息财产价值日益凸显的大背景下,人格权化的个人信息权不仅会给传统人格权理论带来解释困境,而且信息主体的财产利益也难以得到充分维护。因此,在未来的立法修订中,应将个人信息权定位为财产权,这样才符合平等、公正以及民法本质的要求,从而有效地避免理论解释与司法适用的困境,最终信息主体的合法利益也才得以全面保障。

The establishment of the personal information right highlights the protection of individual’s personal information.Due to the old ideologies,personal information right is still defined as the right of personality.It is undeniable that personal information carries personality interests,while from the perspective of the relationship between privacy and personal information right,it shows that the personality interests is consistent with the privacy object.The overlapping protection of personality interests leads to the dilemma of two kinds of rights in judicial application.Besides,in the context of increasingly prominent personal information property value,personalized information right makes the theory of personality right difficult to explain,and it is difficult to adequately maintain the property interests of information subject.Therefore,in the future legislative amendments,personal information right should be positioned as property rights instead,so as to meet the requirements of equality,justice and the nature of civil law.In this way,the dilemma of theoretical interpretation and judicial application could be effectively avoided,and legitimate interests of the information subject could also be fully protected.
