图书馆数字化馆藏作品在公共数字文化工程融合创新发展中的著作权规制

Copyright Regulation of Library Digital Collection Works in the Integration and Innovative Development of Public Digital Cultural Project

在公共数字文化工程融合创新发展的新阶段,为了满足广大读者在大数据背景下对数字资源的需求,图书馆需对其馆藏作品进行数字化复制并向读者提供数字资源服务。文章通过对欧盟法及美国法相关制度的介绍,阐明数字图书馆建设和推广中涉及的著作权问题,从法律和技术两个角度提出我国图书馆数字化馆藏作品著作权保护相关法律制度完善建议。

In the new stage of integrated and innovative development of public digital cultural projects,in order to meet the needs of readers for digital resources under the background of big data,the library needs to digitally copy its collection of works and provide digital resources services to readers.By introducing the relevant systems of European Union law and American law,this paper expounds the copyright issues involved in the construction and promotion of digital libraries,and puts forward some suggestions on the improvement of the legal system related to the copyright protection of digital works in Chinese libraries from the legal and technical perspectives.
