商业化加快背景下无人配送车的监管研究

On Enhancing Regulation of Autonomous Delivery Vehicles Under the Background of Commercialization Acceleration

在许多企业的大力推动下,国内无人配送车逐步形成了以普通型为主导的蓬勃发展格局。当前,在多种有利因素的驱动下,它的商业化进程大大加快。然而,由于法律性质难以界定、现行自动驾驶道路测试监管制度难以应用、技术准入制度建立上存在困难等难题,对无人配送车的监管严重滞后,使其游离于监管之外。随着对它的应用增多,给社会带来的交通安全风险、网络安全风险等也在加大,亟需采取坚持鼓励创新与加强监管并重、明晰它的法律性质、创新监管模式等措施加快制度建设,强化对它的监管。

Through more efforts made by some enterprises,autonomous delivery vehicles have developed drastically in the country,with the focus on the ordinary type.At present,drived by many beneficial factors,their commercialization is speeding up.However,because of some difficulties such as unclear legal nature of them,inapplicability of current regulation system on road testing for autonomous vehicles to them,and difficulty in establishing production licensing system,there are serious regulatory lags,which makes them out of the regulation finally.With the increase of their application,there are more and more risks brought by them such as traffic safety risk and network security risk.For controlling such risks,it is necessary to accelerate the legislations for them and enhance the regulation of them by strong measures,such as attaching equal importance to support and regulation,clarifying the legal nature of them,and making the innovation to regulation mode.
