共享经济模式下的网约车司机劳动权益保障思考

随着共享经济时代的来临,依赖网络平台的新型用工模式应运而生。该模式带动了一大批就业者,创造出了巨大的社会财富,但也给社会带来了一系列亟待解决的问题。目前网络用工平台通过不与网约工签订劳动合同的形式来降低用工成本。同时网约工的劳动权益也得不到应有的保障,维权也较为困难。本文将重点探讨共享经济模式下的网约车司机劳动权益保障,并分别向国家、用人单位、工会提出建议,来切实维护劳动者合法权益。另外,打铁还需自身硬,劳动者自身也应提高劳动权益自我保护意识。

with the coming of the era of sharing economy,the new employment mode relying on the network platform came into being.This mode has brought a large number of employment and created a huge social wealth,but also brought a series of problems to be solved.At present,the network employment platform reduces the employment cost by not signing labor contract with network contractors.At the same time,the labor rights and interests of network contract workers are not guaranteed,and it is difficult to safeguard their rights.This paper will focus on the protection of the labor rights and interests of the drivers of online car Hailing under the mode of sharing economy,and put forward suggestions to the state,the employer and the labor union respectively to effectively safeguard the legitimate rights and interests of workers.In addition,ironmaking needs to be hard on its own,and workers themselves should improve their awareness of self-protection of labor rights and interests.
