The Turn and Path of Systematic Research on the Climate Change Law

早期《应对气候变化法》立法的体系化研究强调整个应对气候变化法律体系的形式构建,随着体系化进程的实质化,研究转向《应对气候变化法》单行法的体系化建构。此时,面临管制性、政策性立法模式选择的矛盾,气候变化信息公开部分的立法体系化能同时兼顾气候变化特殊性与立法模式交叉属性,可作为突破该障碍的切口。应通过协调已有国际条约与国内立法、吸收司法判例实践经验完成该部分的体系化,进而形成对整部法律的体系化指导。

The systematic study of the early"Climate Change Law"legislation emphasized the formal con-struction of the entire climate change legal system.With the substantiveization of the systemization pro-cess,the research turned to the systematic construction of the single law of the"Climate Change Law".Faced with the contradiction of the choice of regulatory and policy-based legislative models,the legislative sys-tem of the climate change information disclosure part can take into account the cross-cutting nature of the climate change particularity and the legislative model,and can be used as a breakthrough to break through the obstacle.The systemization of this part should be completed by coordinating existing international treaties and domestic legislation,and absorbing judicial precedents,thus forming a systematic guidance for the en-tire law.
