德国仲裁立法改革回溯与新动向及其借鉴意义

1997年,德国进行了一次里程碑式的仲裁立法改革。经过约四分之一个世纪,面对21世纪的新形势,德国拟进行仲裁立法现代化改革。回溯1997年德国仲裁立法改革,跟进2023年4月及2024年2月德国联邦司法部推进的仲裁立法现代化改革的新动向,在归纳分析德国1997年改革成效的基础上,评析目前改革方案的关键在于国际化革新与数字化革新。在中国仲裁立法需要改革的当下,回顾德国与国际接轨的里程碑式的改革,观察德国当下拟进行的现代化改革新动向,从微观与宏观两个层面进行剖析,以期适当借鉴,争取为中国仲裁事业的发展及中国仲裁国际竞争力的提升创建较具稳定性及可行性的法律环境,从而在全球治理体系加速变革的21世纪,通过构建具备科学性、国际性、前瞻性、现代性的中国仲裁制度,培育国际商事仲裁友好型法治土壤,维护良好营商环境,促进中国新发展格局的构建与完善。

In 1997,Germany carried out a milestone reform of arbitration legislation.After about a quarter of a century facing the new situations in the 21th century,Germany plans to modernize its arbitration legislation.Looking back at the reform of arbitration legislation in Germany in 1997,and following up on the new trend of modernization of arbitration legislation promoted by the German Federal Ministry of Justice in April 2023 and February 2024,summarizing and analyzing the effect of Germany’s reforms in 1997 and evaluating that the key to the current reform plan lies in international and digital innovation.In the current situation where China’s arbitration legislation needs to be reformed,reviewing Germany’s milestone reform in line with the international standards,observing the new trends of modernization reform that Germany plans to undertake,and analyzing from both micro and macro levels,in order to use for reference appropriately and to strive to create a more stable and feasible legal environment for the development of China’s arbitration industry and the enhancement of China’s international competitiveness in arbitration.Therefore,in the 21st century,through a scientific,international,forword-thinking,and modern Chinese arbitration system,cultivating a friendly legal soil for international commercial arbitration,maintaining a good business environment,and promoting the construction and improvement of China’s new development pattern.
