论构建中国自主的调解学知识体系

面对在人口规模巨大国家实现法治现代化的艰巨任务,为避免成为“诉讼大国”,国家做出“坚持把非诉讼纠纷解决机制挺在前面”的战略部署,调解由此迎来大发展的黄金时代,而调解学也因此迎来最佳发展契机,构建中国自主的调解学知识体系成为法学研究者责无旁贷的时代使命。为此,必须在“中国式现代化”语境下准确把握调解学知识体系的“中国性”。受诉讼中心主义的西方法治话语影响,调解学在我国尚处于被传统法学遮蔽的“失语”状态,调解在我国法学研究和法学教育中尚处于边缘位置。面对这一现实困境,应当突破传统法学的桎梏,理顺调解学与传统法学的关系,扎根于中国调解的实践需求,围绕调解学的核心范畴,加强调解基础理论研究,从学科体系、学术体系和话语体系三个维度着手,把调解打造成一张“国家名片”,把调解学建设成为“人民的学问”。

In the face of the arduous task of realizing the modernization of the rule of law in a country with a huge population,in order to avoid becoming a"litigious society",China made a strategic deployment of"adhering to the non-litigation dispute resolution mechanism in the front",thus ushered in the golden age of great development of mediation,and thus ushered in the best development opportunity for mediation.It is the duty of legal researchers to construct an autonomous knowledge system of mediation in China.Therefore,it is necessary to accurately grasp the"Chineseness"of the knowledge system of mediation in the context of"Chinese modernization".Influenced by the western rule of law discourse of the litigation center doctrine,mediation is still in an"aphasia"state covered by the traditional legal study and is still in a marginal position in the legal research and legal education of our country.In order to get out of this realistic dilemma,we should break the shackles of traditional jurisprudence,straighten out the relationship between mediation and traditional legal study,take root in the practical needs of mediation in China,focus on the core category of mediation,strengthen the basic theoretical research of mediation,and build mediation into a"national name card"from the three dimensions of discipline system,academic system and discourse system.Finally we will make mediation a study of the people.
