大变局时代的国际仲裁——2021年《国际仲裁调查报告》述评

The Great Change and International Arbitration——Review of 2021 International Arbitration Survey

2021年伦敦玛丽女王大学等发布的《2021国际仲裁调查:让仲裁适应变动中的世界》分别针对当前国际仲裁的现实发展、仲裁多样性建设、新技术在仲裁中的应用以及仲裁与可持续发展和信息安全等问题进行了调查与分析。一方面,《报告》延续了以往调查报告的主要内容,实现了对国际仲裁领域关键问题的持续性关注,勾勒出了国际仲裁不断发展变化的制度变迁图景。另一方面,其也基于新冠肺炎疫情的全球蔓延,尝试作出更为现实性和更具前瞻性的研究,以期展望国际仲裁在可预期的未来可能的发展方向。而站在中国的立场上,《报告》的内容及方法也对我国仲裁制度改革和仲裁法学研究具有如下的启示,需要我们站在更为客观的角度加以评估,从而助力于中国的仲裁制度改革和《仲裁法》的修订。

The 2021 International Arbitration Survey:Adapting arbitration to a changing world published by Queen Mary University in London investigates and analyzes the current choices and future adaptations of international arbitration,the diversity on arbitral tribunals,use of technology in arbitration,arbitration and sustainability and information security.On the one hand,the report continues the main contents of previous survey reports,realizes the continuous attention to the key issues in the field of international arbitration,and outlines the prospect of the development and change of international arbitration system.On the other hand,due to global spread of the COVID-19,the report tries to make more realistic and prospective research in order to predict the possible future development direction of international arbitration.From China’s point of view,the contents and methods of the report also have the following enlightenment for the reform of China’s arbitration system and the study of arbitration law.We need to evaluate it from a more objective perspective,so as to help the reform of China’s arbitration system and the revision of the Arbitration Law.
