摘要
本文通过国际技术和商务纠纷中个人调解的五个案例介绍和分析,归纳了商事调解员应该具备的知识结构、拥有的实践经验,以及运用这些知识和经验调解纠纷的综合素质和技能。区别于机构调解,个人调解不是被动地坐等当事人上门,而是积极地深入到企业之中,存在于当事人之内,对于日常频发的商务和技术琐事纠纷,可以随时随地、快捷便利地现场化解矛盾,有时还需要调解员亲赴实地考察和组织现场试验,协助当事人从中找到解决问题的办法。本文建议,我国应逐步放开个人调解业务,作为机构调解制度的完善和补充,广泛地建立分布在社会和企业之中的商事调解员人才库,方便当事人从中自主选择调解员,充分体现当事人的意思自治,适应于国内外市场发展的需要。
Through the introduction and analysis of five cases of individual mediation in international technical and commercial disputes.This paper summarizes that commercial mediators should have the knowledge structure,the practical experience and the comprehensive quality and skills of using this knowledge and experience to mediate disputes.Different from institutional mediation,personal mediation is not passive waiting for the parties to come to mediation,but the mediator should actively penetrate or exist into the enterprise and society.They can quickly and expediently resolve contradictions on-site anytime anywhere for daily frequent business and technical disputes.Sometimes it is also necessary for the mediator to visit the field and organize field trials to assist the parties in finding a solution to the problem.It is convenient for the parties to choose the mediator independently,fully embodies the meaning of the parties‘autonomy,and adapts to the needs of the development of the domestic and foreign markets.
