德国仲裁临时措施制度及其借鉴

The System and Its Reference of Interim Measures of German Arbitration

尽管在德国有关"仲裁程序"的规定被列入《德国民事诉讼法典》第十编,但该编却是独立的一编,有完整的体系,德国学术界通常称其为"仲裁法"。当下的德国仲裁临时措施制度是德国仲裁法现代化的结果。虽然德国仲裁临时措施制度明显受到1985年《联合国国际商事仲裁示范法》的影响,形成了仲裁庭和法院都可以采取临时措施的"双轨制",但仍然保留了本土化的规定,带有明显的自身特点。目前,我国《仲裁法》尚未对仲裁庭采取临时措施作出规定。因此,德国仲裁临时措施制度可为我国《仲裁法》的修改和完善提供宝贵的借鉴经验。

In Germany,the"arbitration procedure"is included in the tenth chapter of German Code of Civil Procedure.However,this chapter is an independent part with a complete system and German academic circles usually call it the"arbitration law".The current German arbitration interim measures system is the result of the modernization of German arbitration law.Affected by the 1985 Unicitral Model Law on International Commercial Arbitration,The System of Interim Measures of German Arbitration has formed a"dual-track system"in which both the arbitral tribunal and the court can take interim measures.But it still retains the localized regulations and has obvious characteristics of its own.At present,the interim measures taken by the arbitral tribunal have not been stipulated in our country’s"Arbitration Law".Therefore,the German arbitration interim measures system can provide valuable reference for the revision and improvement of our country’s"Arbitration Law".
