无居民海岛保护行政执法体系建设对策探析——以辽宁省为例

Countermeasures for the Construction of Administrative Law Enforcement System for the Protection of Uninhabited Islands——Taking Liaoning Province as an Example

无居民海岛属于国家所有,因其兼具生态效益和经济效益两种属性,且生态效益远大于经济效益,对无居民海岛的治理方针一直坚持“保护为主,利用为辅”。以辽宁省相关实践为例,分析无居民海岛保护行政执法体系架构,以及无居民海岛保护行政执法面临的主要问题,提出补充无居民海岛保护行政执法实体规定和程序规定,细化无居民海岛保护行政执法权的权责配置,建立健全无居民海岛保护执法综合协作机制和监督机制,强化地方海岛执法信息系统及人才队伍建设等推进无居民海岛保护综合执法体制改革的路径。

Uninhabited islands belong to the state.As they have both ecological and economic benefits,and the ecological benefits far outweigh the economic benefits,the governance policy for uninhabited islands has always adhered to the principle of“protection first,utilization second”.Taking relevant practices in Liaoning Province as an example,this paper analyzes the architecture of the administrative law enforcement system for the protection of uninhabited islands,as well as the main problems faced by the administrative law enforcement for the protection of uninhabited islands.It is proposed to supplement the substantive and procedural provisions for the administrative law enforcement of uninhabited island protection,refine the allocation of rights and responsibilities for the administrative law enforcement power of uninhabited island protection,establish and improve a comprehensive cooperation and supervision mechanism for the protection and law enforcement of uninhabited islands,and strengthen the construction of local island law enforcement information systems and talent teams to promote the reform of the comprehensive law enforcement system for the protection of uninhabited islands.
