网络刷单行为的经济法规制

Economic Law Regulation of Online Brushing Behaviour

随着互联网的发展,电商成为了经济市场的重要组成部分,与此同时,市场中的网络刷单现象也日益严重,极大地扰乱了市场竞争秩序。我国电商法的出台对网络刷单行为的规制受到了法学界的重视,如何采取有效规制手段实现全方位综合治理是亟待解决的问题。本文首先概述了网络刷单行为的法律定义与特征,论述了网络刷单行为法律规制的意义,之后分析了网络刷单行为的现状与法律规制中存在的问题,最后从经济法的角度提出了规范网络刷单行为的对策措施。

The development of internet has made e-commerce become an important part of economic market.At the same time,increasingly severe online brushing behaviour has greatly disrupted market competition order.The introduction of e-commerce law has regulated online brushing behaviour to some extent,which has received the attention from the legal community.How to adopt effective regulatory means to achieve comprehensive governance is an urgent problem to be solved.The paper firstly summarized the legal definition and characteristics of online brushing behaviour,and discussed the significance of legal regulation.On this basis,the paper later analyzed the current situation of online brushing behaviour and the existing problems of legal regulation.Finally,the paper proposed the countermeasures to regulate online brushing behaviour from the perspective of economic law.
