元宇宙概念具有高度复杂性与抽象性的特征,造成其在底层架构技术层面和应用层面上存在诸多不确定性因素。受区块链技术的影响,现阶段的元宇宙应用根据其技术特点至少可以划分为中心化元宇宙与去中心化元宇宙两种类型。前者平行独立于现实世界,同时是利用高新数字技术创造出的虚拟空间,而后者则是前者的具体化,其本质上是区块链数字货币网络,具有匿名化、去中心化的特点,这使得其容易成为资本炒作投机活动的媒介,甚至可能逐渐演变成违法犯罪活动的工具,还可能引发货币主权风险、政治风险、非法交易风险。鉴于此,需要在厘清去中心化元宇宙本质的前提下,采取中立的规制方式,并根据其发展变化灵活地调整相关规则体系内容,以实现对去中心化元宇宙的有效规制。
