The Construction of Long-term Prevention and Control Mechanism of Evil Forces Crime from the Perspective of Blocking Constituent Elements

恶势力被认定为加重量刑情节,原因在于恶势力组织的存续具有社会危害性。依据这一特征,除恶工作宜聚焦于阻断恶势力的构成要素,如此才能更好地贯彻“打早打小”的刑事政策,提升恶势力犯罪预防的主动性。这一防治思路可以从危险的事前控制、犯罪构成理论以及涉黑犯罪防治中寻得理论支撑。恶势力防治政策应以恶势力的四个构成要素为基础设计具体的阻断措施,政策主线包括动摇犯罪组织的稳定性,控制违法犯罪分子的纠集频率,重治暴力、威胁类违法犯罪,严防团伙犯罪影响范围扩大四个方面。

Evil forces are regarded as aggravating circumstances of sentencing,which is rooted in the social harmfulness of the existence of the organizational form of evil forces.According to this feature,the antievil work should focus on the blocking of the constituent elements of evil forces.It can better implement the criminal policy of"struggle against minor offence",improve the initiative of crime prevention of evil forces,and better meet the requirements of normal crime prevention of evil forces.This prevention and control idea can find theoretical support from the prior control of danger,the theory of crime constitution,and the prevention and control of underworld related crimes.The prevention and control policy designs specific blocking measures based on the four elements of evil forces,the main policy line should focus on shaking the stability of criminal organizations,controlling the gathering frequency of criminals,severely punishing violent and threatening crimes,and strictly preventing the expansion of the scope of influence of gang crimes.
