PBP型权利要求(product-by-process claim)保护范围的解释一直是新材料领域专利确权过程中的难点,因为在各个阶段都没有统一的标准。本文比较了各国的处理方式,尤其是美国相关判例的进展为基础进行分析和研究,对我国在审查及司法实践中易出现的问题进行分析,提出一些可行的建议。

In the field of new materials,it is difficult to explain the protection scope of product-by-process claims in the process of patent right determination,as there is no uniform standard for it at each stage.The paper analyzes and researches the common problems in the inspection and judicial practice in China on the basis of the processing modes of various countries,particularly the latest progress of related cases in the U.S.,and gives feasible suggestions.
