Legal Ideology in the Implementation of Voluntary Standards

我国《标准化法》对"标准化"的定义明确了标准化活动的3个层次:标准的制定、标准的实施以及标准的监督,体现了标准化作为现代质量治理的重要一环,其所追求的"最佳秩序"开始转向提升实施侧需求的转变趋势。我国推荐性标准外延复杂,实施场景二元化,这就会导致推荐性标准在实施中会产生信息碎片化、动机内在冲突、条块分割化的制度问题,因此有必要在推荐性标准实施的法治化建设中树立系统性、规范性、协调性的理念,通过建立立体化标准实施推广机制、绩效化标准实施评价机制、开放化标准实施参与机制来推进推荐性标准实施的法治化建设,进而提升质量法治的整体效能。

The definition of"standardization"in the Standardization Law of China defines three levels of standardization activities:standard development,standard implementation and standard supervision,which reflects standardization,as an important part of modern quality management,pursues the"the optimum degree of order"to improve the implementationside demands.In China,the denotation of voluntary standards is complex and the implementation scenario is dualistic,which will lead to the systematic problems of information fragmentation,internal conflict of motivation and fragmentation in the implementation of voluntary standards.Therefore,it is necessary to establish the concepts of"systematization,regularization and coordination"in the legal ideology in the implementation of voluntary standards.The establishment of three-dimensional standard implementation promotion mechanism,performance-based standard implementation evaluation mechanism and flat standard implementation participation mechanism can promote the law construction of recommended standard implementation,and then improve the overall governance efficiency of quality legal system.
