摘要
在我国《专利法》及其司法解释对于律师费转付缺位的情形下,司法实践中却存在径行裁定由败诉方承担胜诉方律师费,并区别对待被控侵权人律师费赔偿请求的不合理与不公平现象。对此,我国专利诉讼律师费转付制度应当在厘清律师费的惩罚性赔偿性质的基础上,吸取美国专利诉讼律师费转付制度的有益成分,对适用情形、胜诉当事人和合理律师费等内容予以明确规定。
There is an unreasonable and unfair trend that the court determines the losing party bearing the lawyer’s fees of the winning party when there are no rules of payment of lawyer’s fees and treats the compensation request of lawyer’s fees of the accused infringer differently.In order to solve it,we should clarify the nature of transfer patent lawyer fees as a punitive damages and then draw on the beneficial elements of the United States patent litigation lawyer fee transfer system,and make clear the conceptions of winning parties and applications of transfer patent lawyer fees.
