论发行权用尽原则在网络领域的适用

On the Application of First-Sale Doctrine in the Online World

我国学界主流观点认为发行权仅能规制线下行为,否定发行权用尽原则在网络领域的适用,网络二手版权交易市场自无发展空间。"转移-删除"技术能够确保网络交易中复制件的数量不变,充分拟制线下发行行为,宜用发行权来规制。网络环境下以"许可"替代"销售"的实践不改消费者获得所有权的本质,转售方保留复制件对一级市场的损害也可通过加重网络二手交易平台注意义务的方式解决,适用发行权用尽原则并无实质障碍,并能产生抑制权利滥用、打击盗版的正面效果。

The notion that "the right of distribution is set to control offline behavior" has been widely recognized by Chinese scholars,which leaves no room for the application of first-sale doctrine in the online world,thus prohibiting the emergence of an online second-hand copyright transaction market. With the technology of "transfer-and-delete",an online copyright transaction market that resembles offline second-hand market can be established,which shall be governed by the right of distribution. The essence of transaction is not changed whatever contractual term is used,whether "sale" or "licence". Enhanced duty of care requirement of online second-hand copyright transaction market can be employed to counterbalance the damage concurred by online seller’s failure of deletion. There’s no material obstacle to the online application of the first-sale doctrine. Such application will inhibit online copyright misuse and function as an effective way of combating piracy.
