摘要 《关于深化新时代教育督导体制机制改革的意见》提出要建立教育督导与教育行政审批、处罚、执法的联动机制,成为本次《意见》的一大亮点。教育督导和教育行政执法在行为目的、主体、对象、内容、结果等方面既有区别又有紧密联系,这构成了两者得以协同的契合点。在推进教育治理体系和治理能力现代化的进程中,建立教育督导和教育行政执法协同机制,是推进依法治教的内在需求,是实现"管办评"分离的重要抓手,也是协同治理理论在教育治理的现实践履。实践表明,建立教育督导和教育执法有效协同机制,要理清教育督导与教育行政执法的职责关系,推进二者在权力配置、机构设置、流程管理、资源利用等各方面对接耦合,形成"信息互换、执法互助、结果互认"的良性互动。 the opinions on deepening the reform of educational supervision system and mechanism in the new era proposes to establish a linkage mechanism between educational supervision and educational administrative examination and approval,punishment and law enforcement,which has become a highlight of the opinions.Educational supervision and educational administrative law enforcement are different and closely related in the purpose,subject,object,contentand result,which also forms the joint point of their coordination.In the process of promoting the modernization of educational governance system and governance capacity,the establishment of a collaborative mechanism of educational supervision and educational administrative law enforcement is the internal demand of promoting the rule of law in education,an important starting point to realize the separation of"management,operation and evaluation",and also the practical practice of collaborative governance theory in educational governance.Practice shows that in order to establish an effective coordination mechanism between education supervision and education law enforcement,it is necessary to clarify the responsibility relationship between education supervision and education administrative law enforcement,promote the docking and coupling of the two in power allocation,organization setting,process management,resource utilization and other aspects,so as to form a benign interaction of information exchange,mutual assistance in law enforcement,and mutual recognition of results.
