民办高校二级学院的权力配置:行动逻辑、现状反思与完善路径

民办高校基于其产权结构及法人属性,在二级学院权力配置中具有权力性质私法性、权力运行市场性及权力配置集中性特征。对100所民办高校的章程分析表明,当前民办高校二级学院的权力配置具有"行政化"与"市场化"双重色彩,呈现出重管理轻治理、重市场轻公益、重行政轻学术倾向。民办高校系"底部沉重"的权力分散型组织,在二级学院权力配置中应引入利益相关者治理理念。在增强二级学院自主权的基础上,建立起"政治引领、学术主导、行政服务、民主参与"的权力配置体系。同时,民办高校从完成分类登记、完善治理结构,学校外部从加强治理监督、提供政策支持等方面给予配套支撑。如此方能实现自主性与公共性之平衡,提升民办高校二级学院治理水平。

Due to the property right structure and legal personality of private universities,the power allocation of secondary colleges in private universities has the following characteristics:the nature of power is private,the operation of power is marketoriented,and the allocation of power is concentrated.The analysis of the articles of association of 100 private universities shows that the current power allocation of secondary colleges in private universities has the dual colors of"administration"and"marketization",showing a tendency of emphasizing management over governance,market over public welfare,and administration over academic.Private universities are decentralized organizations with"heavy bottoms"and the concept of stakeholder governance should be introduced in the power allocation of secondary colleges.On the basis of strengthening the autonomy of secondary colleges,a power allocation system of"political guidance,academic center,administrative service and democratic participation"should be established.At the same time,private universities should provide support referring to completing classified registration and improving the governance structure.And form outside of universities,support focusing on strengthening governance supervision and providing policy support should be established.Only in this way can we achieve the balance between autonomy and publicity and improve the level of governance of secondary colleges in private universities.
