云计算平台知识产权间接侵权责任认定研究

云计算平台的复合技术框架与糅合服务模式,使其在知识产权间接侵权责任认定过程中面临着严峻挑战。针对传统网络服务提供者设计的“通知—必要措施”规则并不能在云计算场景下的知识产权间接侵权判定中予以有效适用。司法实践中,我国法院立足云计算产业发展实际,从“通知—必要措施”规则设立目的出发,已在很大限度上阐明“通知—必要措施”规则接纳云计算平台等新型主体的必要性,以及其“必要措施”要件在云计算场景下予以扩大解释的可行性。为进一步化解云计算平台“通知—必要措施”适用难题,应在明确云计算平台合理注意义务标准的基础上,在云计算场景下阐释“通知”与“必要措施”要件的内涵,通过多层次、多回合的“转通知”和配套“必要措施”运转程序设计,专门创设契合云计算平台需要的知识产权间接侵权责任认定机制。

The composite technology framework and hybrid service mode of cloud computing platform make it face severe challenges in the process of identifying the indirect infringement liability of intellectual property rights.The“Notification-Necessary Measures”rule designed based on traditional network service providers cannot be effectively applied in the determination of intellectual property indirect infringement in cloud computing scenarios.However,the judicial practice that is based on the development status of cloud computing industry and the purpose of“Notification-Necessary Measures”rule,to a large extent,clarifies the necessity of the“Notification-Necessary Measures”rule to accept new subjects such as cloud computing platforms,and the feasibility of expanding the interpretation of its“Necessary Measures”elements in the cloud computing scenarios.Therefore,in order to solve the practical problems of identifying the indirect infringement liability of intellectual property rights of cloud computing platforms,we should create a new mechanism that meets the needs of the cloud computing platforms by explaining the connotation of the elements of“Notification”and“Necessary Measures”in the cloud computing scenario,and designing the operation program with multi-level and multi-round that takes“Transfer Notification”and supporting“Necessary Measures”as the route on the basis of clarifying the standard of reasonable duty of care for the determination of indirect infringement liability of intellectual property rights of cloud computing platforms.
