摘要
随着平台经济、共享经济、数字经济等新兴业态的蓬勃发展,新就业形态不断涌现,为我国就业创造了新的空间和机遇。然而,由于新就业形态灵活的用工形式突破了传统劳动关系认定范畴,催生出了不完全劳动关系,但是与此相配套的劳动者权益保障制度尚未形成,出现了劳动关系法律认定难、劳动权益保障不完善、劳动争议机制不健全和劳动监察执法成本高等问题。文章拟通过明确劳动关系认定标准、规范平台管理行为、完善劳动争议机制和建立多元社保机制四方面举措,为我国新就业形态中不完全劳动关系劳动者权益保障制度提供思路。
With the vigorous development of emerging industries such as platform economy,sharing economy,and digital economy,new types of employment continue to emerge,creating new space and opportunities for employment in China.However,due to the flexible employment forms of the new employment types breaking through the traditional scope of labor relations recognition,incomplete labor relations have emerged.However,the corresponding system for protecting labor rights and interests has not yet been established,resulting in difficulties in legal recognition of labor relations,inadequate protection of labor rights and interests,inadequate labor dispute mechanisms,and high costs of labor inspection and law enforcement.This article intends to provide ideas for the protection system of labor rights and interests in incomplete labor relations in China’s new employment types through four measures:clarifying the standards for recognizing labor relations,regulating platform management behavior,improving labor dispute mechanisms,and establishing a diversified social security mechanisms.
