粤港澳大湾区破产法律制度之困境与完善

在深入推进粤港澳大湾区融合发展的背景下,为妥善化解现行破产法律制度存在的难题,促进粤港澳三地在跨境破产领域的合作,需充分、准确地理解粤港澳大湾区的破产法律制度。在各具特色的立法基础上,相互借鉴经验,完善三地的个人破产、企业破产、破产管理人及相关配套的法律制度,本着互惠与协调发展的精神,确立主要利益中心地标准、区分主要和附属破产程序、设立三地破产登记簿以达成跨境破产合作专门法律安排。

Under the background of deepening the integration and development of the Guangdong-Hong Kong-Macao Greater Bay Area,it is necessary to fully and accurately understand the bankruptcy legal system of the Guangdong-Hong Kong-Macao Greater Bay Area in order to properly solve the problems existing in the current bankruptcy legal system and promote cooperation among the three regions in the field of cross-border bankruptcy.On the basis of distinctive legislation,we should learn from each other's experience,improve the legal systems of personal bankruptcy,corporate bankruptcy,bankruptcy administrators and related supporting systems in the three regions.In the spirit of mutual benefit and coordinated development,we should establish the standards for the center of main interests,distinguish between main and subsidiary bankruptcy procedures,and establish bankruptcy registers in the three regions to achieve specialized legal arrangements for cross-border bankruptcy cooperation.
